Divorce Mediation Process

The process of divorce mediation requires a neutral third party, called a Mediator, to meet with the involved parties in an attempt to resolve their disputes and facilitate a settlement agreement. All matters pertaining to mediation are confidential during the settlement negotiations. Mediation is not a mandatory requirement of the court, nor are the parties obligated to reach a settlement agreement.

Mediators are chosen based on their specific expertise or knowledge of the law. In some cases, a divorcing couple may choose to hire a mediator in an effort to discuss and resolve their divorce issues out of court, with or without the involvement of an attorney. This enables the couple, not the court, to control the outcome of their divorce settlement.
