If you and your spouse decide collaborative divorce is the best option for your family, then you each engage a collaborative attorney, and the process begins. An agreement is made between all parties not to litigate. If one party decides to go to court, both attorneys are required to withdraw from the case. This incentivizes attorneys and spouses to remain at the negotiating table instead of disrupting the process to increase legal fees by incurring court costs.
A series of meetings is then scheduled between both parties and their attorneys. The couple works together during these meetings to reach an honest and amicable settlement. Both parties also have the support of a divorce coach (to help manage the ups and downs of the divorce process from a stressful and emotional perspective and assist with the Parenting Plan, if there are children) and a financial neutral (to assist in understanding future cashflow, creating financial working documents for settlement discussions and to otherwise help in developing financial solutions).
